If your chief response is "the ban didn't involve Big Gulps," you've utterly failed to understand the point of the protest against a nanny state that believes it has the right to tell you how much of a legal food you can purchase.

If you need to fall back on the "a judge struck it down" defense after that, you miss the point that it was only struck down on procedural grounds (was done by fiat, was not done equally as a result) and that the point remains that there are people who think this is good policy.

There are two sides to the issue though.

Doesn't NYC have every right to deal with local issues in the way that they see fit? The way that the city council for The Bronx, Manhattan, Brooklyn, Queens and Staten Island wish to deal with them? (I know that there is debate over how actual citizens feel about the ban, but borough citizens elected their council representatives.)

Look, I hate Democrat matriarchal politics in every way - It's one of the reasons I left NYC. But I don't like the GOP patriarchal politics either. The point is that I left. If they want to nanny up the City, that's fine. I don't have to live there. But, the GOP seems to think it's just fine to interfere in local politics as long as it's about god, abortion and immigration.

Telling people that they can't get a huge soda at a bodega in NYC is a far cry from overturning a Supreme Court decision that ensures women have privacy in their reproductive decision making. Palin didn't even know that's what Roe v Wade was about. That's what people are mocking.

I find it interesting you differentiate between "legal" and "illegal" food. The government regulates how much alcohol we can consume (portion sizes, density) should it not be able to regulate because the drug is sugar instead of fermented sugar?

I am looking for your justification which shows that one of these is not a right that the state has and one of them is a right that the state has.

I am not looking for an answer that tells us whether its a good idea or not, because there are plenty of things the U.S.G. has the power to do that are not good ideas.

I know Bloomberg isn't popular for a variety of reasons, but new studies show NYC lung cancer rates are lower than the rest of the state; and other health statistics have shown an improvement over the last ten years as well. Stores will now also be required to hide cigarettes out of public view too. Several cities in Canada have already done this, and it's helped reduce cigarette smoking significantly.

I think the ban is a good thing personally. I think a lot of people miss that it's stopping people *selling* big drinks, not stopping people from consuming a lot of sugary drinks. Post mix soft drink costs cents, so drinks have been getting bigger for years to make it seem like there is more value. There are commercial reasons why the drinks have gotten bigger, and it isn't demand, it's perception. Unfortunately this has massive negative public health consequences; things that everyone has to pay for, even if you don't have universal health insurance. Therefore it is right that the state should be able to sanction it for the greater good.

The nanny state wouldn't have to exist if people didn't make such bad choices, the consequences of which are felt by other people. But people make bad choices, irrational choices all the time (this is why Austrian economics is wrong). At least this slows it down a little, and hey, it doesn't stop you from drinking all the soft drink you want, it just stops *too much* soft drink being the best deal.

"It's for your own good" is a terrible reason to act, as is "if you only made the decisions I wanted you to make..." People are fully capable of handling the results of their actions on their own, and to pretend that everyone needs to be impacted by a policy because a select few might be adversely impacted by their own choices is pretty dumb. It's the same logic behind marijuana prohibition, and that's gone swimmingly.
