Soda sales are heavily invested in interstate commerce, particularly those that were covered under the NYC fountain limit. Guess it's constitutional after all!

If I buy a soda from down the street, I haven't crossed state lines. You also cannot guarantee that the soda I bought was not created or distributed over state lines. Wickard wasn't a good ruling.

Actually I can guarantee that if you are from any number of states in the US. Soda is manufactured in large hubs close to raw materials and shipped to bottling plants. If you live in Colorado or Utah or Vermont or New Hampshire you are importing every drop of soda you drink. Or if I see your ass drinking a bottle of Faygo in Mass. I know already that it was produced in Michigan. Kinda meets the definition of interstate commerce...
