It's been real folks, but I've decided to depart from this community. Not because it's headed downhill, or because anyone in particular annoyed me, but it's just time to find something else to do for a while. I particularly would like to thank our lovely host lyndz for running such an interesting community. I know I've had my disagreements with many of you, but I hope nobody took it too seriously. Even among those I disagree with, there are many decent and thoughtful people here. I wish you all well.

That is not mainstream liberalism, everyone hates the ruling. What happened was precedent creep on the 5th amendment.

Luckly, if congress wants to, they can reverse the ruling through legislation.

A fairly conservative reading of the elastic clause, the 5th, and 9th amdendment allow for chaning the law regarding what happened.

Nothing stops the legislature from limiting itself more through legislation.

Unfortunately, the 9th amendment is largely a dead letter with the modern court. That's the amendment Robert Bork famously referred to as the "ink blot" on the constitution.

Yea, but that doesnt mean that the legislature cant use it to justify legislation.

The basis is that the law is nessesary and proper to enforce the other edicts the constitution grants.

These are 1. Property rights, 2. the 5th amendment conpensation for "public good" and 3. the rights retained by the people.

So, in order to enforce the constitution, the legislature must limit the government in what types of land use it may take land for with just compensation.

I don't think it was a very liberal ruling in any sense, it just happened to be that the liberal wing of the court was the majority. The result: a little guy getting screwed by the government acting on behalf of a big and powerful corporation, is generally the kind of thing liberals decry.

I'm sorry to leave too, you really do run a great community here. I've always found you to be very reasonable and fair, and I've admired your candor when people start acting like children. If you're ever in the Philadelphia area, drinks are on me!

Hahaha... I guess I should have checked your birthdate before offering Jesus Juice to a "minor" :) Looking at your userinfo though it seems we have at least one thing in common: we both lost our mothers prematurely. My mother died of breast cancer when I was a sophomore in college. Horrible thing to have in common really.

I'll also stroke the ego and lament your leave. This community is still very interesting to me, but I haven't had the same time as I've had before. I'll lament your loss more than ILovetheCure, since while he may have sparked the most conversation, you always had the most structured arguments with good sense backing it up.

That's very kind of you. I think the reason it's not the same time as it used to be is that politics is getting kind of boring again. It's hard to make a good cartoon about social security reform or fillibusters, and you can only make so many anti-war cartoons before it all just looks like reruns.

No.. if anything they might pick up a bit. I only have so much energy for LJ, and a lot of it has been directed to this community rather than my personal journal. If the Supreme Court keeps handing down boneheaded decisions like this, I should have plenty to write about :)
