That would be fine, but the thing that you're ignoring is the fact that none of the detainees in Gitmo are terrorists, nor have they ever supported or harbored terrorists.
Sure, let's lock 'em up and convict them. If we're so sure they're terrorists, we must have pretty good evidence proving that, right? We can do this right, but we're not at the moment.

Hey, I have a great idea - why don't we send people who have been accused of terrorism to do hard labor in Prudhoe Bay? Worst case scenario, oil production goes up. There's no down side! I have a hard time understanding why conservatives are so afraid of the american justice system. Whats wrong with giving everyone in Gitmo a fair trial, releasing the ones who have been wrongfully imprisoned and punishing the guilty? Why do conservatives support the legal limbo that the Gitmo detainees are currently in? It tarnishes america's reputation for no gain that I can see.
Because these aren't criminals. They're combatants. The reason we're taking them prisoner isn't because of things that they have done, but what they're going to do. The reason that they're at Gitmo isn't to punish them, but to keep them off the battlefield and to get information out of them.
If all we're going to do is arrest them and give them a lawyer, then we might as well just keep having Predator drones pump Hellfire missiles into Waziristan. If we keep that up then nobody will let anyone from Al Qaeda into their house, lest it just randomly explode.
